The petitioner seeks bail in a case registered for the offence under Sections 30(a) / 36 of Bihar Prohibition, Sections 272, 273, 34 of the I.P.C. and Excise Act and Sections 8, 20(b) (ii)(c) of the N.D.P.S. Act.

18 liters of illicit foreign liquor has been recovered from an Indica car, whereas 500 gm. of Ganja was recovered from the possession of co-accused Raja Kumar and petitioner was one of the occupant of the car and apprehended on spot. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got criminal antecedent and he is accused in two cases of similar nature. Petitioner is in custody since 17.08.2021.

Patna High Court CR. MISC. No.58023 of 2021(2) dt.17-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the fact that petitioner is accused in two more cases of similar nature, the learned court below, where the case is pending, is directed to release the petitioner on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S.
