The statement of the victim has been recorded under Section 164 Cr.P.C. in which she stated that on the offer of petitioner she went to Bombay along with the petitioner and she as well as the petitioner were brought to Patna from Bombay by her parents and after that she as well as the petitioner were caught by the police.

Contention on behalf of the petitioner is that learned Magistrate has recorded the statement of the victim and assessed her age at 17 years and the Doctor found the victim aged about 18 years. It is the further contention on behalf of the petitioner that the statement of the victim reflects that the victim and the petitioner were in love and the victim left her home on her own

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner Chandan Kumar Singh be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur, Ara, in connection with Udwantnagar P.S.
