The petitioner seeks bail in Cheriya Bariyarpur P.S. Case No. 216/2014, registered for the offences punishable under Sections 307, 385 and 387 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that firstly Shambhu Singh came into the poultry farm of the informant and took a hen from the farm. On refused by the informant Shambhu Singh threatened him and after sometime the petitioner and Shambhu Singh again came and demanded extortion of Rs. 5000/- and forcibly took away two hens.

It is submitted that there is allegation of firing but nobody

Patna High Court Cr.Misc. No.13303 of 2015 (4) dt.31-07-2015 2/2 injured. The petitioner has falsely been implicated in the case. The petitioner is in jail since 19.11.2014. Except this case petitioner has got no criminal antecedent.

Having considered the fact that the petitioner has already remained in jail for about eight and half months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Cheriya Bariyarpur P.S. Case No. 216/2014.
