JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with accusation that he opened fire causing fire-arm injury to injured, Ram Bhagwan Singh, who appears to have sustained simple injury, said to be caused by fire-arms.

Submission on behalf of the petitioner is that the prosecution party forcibly got opened a door towards disputed land in respect of which, proceeding under Sections-144 & 145 of the Cr.P.C. was pending and due to the aforesaid land dispute, the present occurrence appears to have been taken place. Moreover, the petitioner is languishing in jail custody since 28-11-2015 without having any criminal antecedent.

No.3398 of 2016 (2) dt.03-02-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Udwant Nagar P.S. Case No. 228 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Bhojpur (Ara).
