2. The petitioner seeks bail in connection with Dhanaha P.S. Case No.207 of 2022 instituted for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, total 267 liters of illicit liquor has been recovered from a car.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence and has falsely been implicated in this case. He is the driver of the vehicle and has no concern with the alleged recovered liquor. He further submits that the name of the petitioner has surfaced

Patna High Court CR. MISC. No.55417 of 2024(2) dt.02-08-2024 2/2 in this case only on the basis of confessional statement of coaccused Anita Verma. There is no any independent witness of the seizure list. He is languishing in judicial custody since 08.02.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case and submissions made on behalf of the petitioner that similarly situated co-accused persons namely, Anita Verma and Manjit Malik @ Manjeet Mallik @ Sonu have been granted bail by this Court and a co-ordinate Bench of this Court in Cr. Misc. Nos. 7597 of 2023 and 20517 of 2024 vide orders dated 03.05.2023 and 18.03.2024, respectively, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bagaha, West Champaran in connection with Dhanaha P.S. Case No.207 of 2022.
