JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named and in course of investigation, the name of petitioner surfaced and accordingly, he was arrested and confessed his guilt but except the confessional statement of petitioner and other accused as well as his criminal antecedent, there appears to be nothing against the petitioner. It appears from perusal of the impugned order that petitioner was put on Test Identification Parade but he was not identified by the witnesses.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.3589 of 2016 (2) dt.04-02-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Hilsa, Nalanda in connection with Ekangarsarai P.S. Case No. 102 of 2015.
