2. The petitioner seeks bail in connection with Phulwariya P.S. Case No. 41 of 2021 registered for the offence punishable under Section 302, 120(B), 201/34 of the Indian Penal Code.
3. As per the prosecution case, the allegation against the petitioner is that he alongwith other accused persons have murdered the husband of the informant by giving poison and thrown the dead body in the Sukhnahar canal.
4. The petitioner is in custody since 15.04.2025.
5. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case only on the basis of
Patna High Court CR. MISC. No.50856 of 2025(3) dt.15-10-2025 2/2 suspicion.
6. Learned counsel for the petitioner further submits that there is no eye witness of the alleged occurrence.
7. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Phulwariya P.S. Case No.41 of 2021, subject to the condition that the petitioner, after being released on bail, shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
