JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant's daughter is languishing in custody since in a case registered for the offences punishable under Sections 341,498A,323,379,307 and 504/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that the daughter of the informant is mentally abrased, still the petitioner is ready to keep her as wife with due dignity and honour. Statement to the aforesaid effect has been made in paragraph 10 of the petition which reads as follows: "That in spite of mental unfit of the victim the petitioner
Patna High Court Cr.Misc. No.4412 of 2016 (2) dt.28-01-2016 2/2 is ready to maintain and keep her with honour." Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Barh, Patna in connection with Mokama P.S. Case No. 147 of 2015.
