Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 41(i) and 42(ii) of the Bihar Prohibition and Excise Act, 2016.

Huge quantity of foreign liquor was recovered from a vehicle though petitioner was not there at the time of recovery. However, he was implicated on the statement of co-accused that the liquor was of the petitioner. Petitioner has got two identical criminal antecedents, besides other criminal cases. Considering the entire facts, let the petitioner, above named, be released on bail if the trial is not concluded within six months from the date of framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand)

Patna High Court CR. MISC. No.45402 of 2019(2) dt.25-07-2019 2/2 with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Tajpur (Halai O.P.) Police Station Case No.85 of 2019, subject to condition that both the bailors shall be resident of territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
