JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other allied Sections of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, this petitioner along with co-accused, Amarjeet Jha, Ashok Singh, Umesh Singh and Mukesh Safi assaulted Amrendra Singh with pistol and iron pipe as a result of which he sustained injuries and died during the course of treatment leading to registration of FIR. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that informant is not an eye witness of the occurrence. There is allegation of assault by five persons, including this petitioner, but only two fire arm injuries have

During the course of investigation grand son of the informant, who claimed himself to be an eye witness of the occurrence, has not whispered anything against this petitioner. Petitioner claims clean antecedent and is in custody since 20.04.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the period of custody of the petitioner and the autopsy report coupled with clean antecedent of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Benipatti PS case No.67/2021.
