1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 366(A) and 120B of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner nos. 1, 2 and 3 are women. It is next submitted that petitioner no. 1 is mother of Mandip, petitioner nos. 2 and 3 are sisters of Mandip and petitioner no. 4 is brother of Mandip and the informant
Patna High Court CR. MISC. No.46411 of 2025(3) dt.15-11-2025 2/3 alleges that on 14.11.2022 at 08:00 AM, her minor daughter aged about 16 years 7 months went out of the house, but did not return, thereafter it is alleged that Mandip kidnapped her with an intention to marry, further when informant went to the house of Mandip when the petitioners abused and assaulted her.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that victim came back and her statement was recorded under Section 164 Cr.P.C. wherein she supported the case of the prosecution and has implicated the entire family members of Mandip including the petitioners. It is further submitted that the statement of the victim was recorded under Section 164 Cr.P.C. under parental pressure. It is also submitted that even presuming what has been alleged is true without admitting then thrust of the allegation is against Mandip.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on
Patna High Court CR. MISC. No.46411 of 2025(3) dt.15-11-2025 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nathnagar (Madhusudanpur) P.S. Case No. 887 of 2022 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application is allowed.
