JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bakhtiyarpur P.S. Case No. 18 of 2014 for the offence under Sections 341, 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 12.04.2019 and, as such, he has now completed more than nine months. However, he submits that allegation of firing is not only against the petitioner but against the others also.
Considering the nature of allegation and the fact that the petitioner has remained in custody for more than nine months, the petitioner, named above, is directed to be released
Patna High Court CR. MISC. No.46754 of 2019(4) dt.03-02-2020 2/2 on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 18 of 2014. However, the Court below is directed to conclude the trial on the day to day basis within a period of six months from the date of receipt/production of a copy of this order. In the event, the petitioner is found in delaying the conclusion of trial, the court below shall be at liberty to cancel his bail bonds.
