The petitioner seeks his bail in Sherghati (Dobhi) P.S.Case No.152 of 2014 registered under Sections 302/201/34 of the Indian Penal Code.

The informant alleged that the petitioner has killed his brother.

It has been submitted that on behalf of the petitioner that the occurrence is alleged to have taken place on 11.6.2014 but the FIR has been instituted on 13.6.2014 and the delay has not been explained. From perusal of the record, it appears that only on the basis of suspicion, the petitioner has been named in the present case. Further, it has been submitted that there is no eye witness of the occurrence and that the petitioner is in custody since 4.1.2015. On behalf of the State it has been stated that the petitioners are named in the FIR.

Considering the facts aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.15849 of 2015 (2) dt.08-06-2015 2/2 each to the satisfaction of the Sub Divisional Judicial Magistrate, Sherghati in connection with Sherghati (Dobhi) P.S.Case No.152 of 2014.
