The petitioner apprehends his arrest in C-III Case No.118 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The Excise officials arrested one person namely, Jitendra Chaudhary and 180 ml. liquor was said to have been recovered from Jitendra Chaudhary. The excise official further disclosed that petitioner fled away after throwing a bag containing 35 bottles each containing 180 ml. The learned counsel for the petitioner submits that petitioner was not accompanying Jitendra Chaudhary. The excise official also implicated the petitioner at the instance of Jitendra Chaudhary. Nothing has been recovered from the

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with C-III Case No.118 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
