The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Allegation is that 5-6 unknown miscreants looted away gold and diamond jewellery, gold biscuits and cash of Rs.4-5 lakhs, by lying the hands and legs of staff of the informant, who were on guard duty, by breaking open the lock of main door and godrej of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.10.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court CR. MISC. No.55337 of 2019(2) dt.03-09-2019 2/2 named in the F.I.R. His name has come on self confession made before the police. The petitioner has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge, Gaya in connection with S.Tr. No.5 of 2019 arising out of Rampur P.S. case No.274 of 2018. (Sudhir Singh, J) Narendra/- U T
