Petitioner is languishing in jail custody since 30-11-2015 on the accusation that one co-accused, who was caught on the spot, disclosed the name of the petitioner. Moreover, even if, prosecution story assumed to be true, then also, only an attempt was made to commit cheat.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jagdishpur P.S. Case No. 233 of 2014 to the satisfaction of Miss Namita Singh, learned Judicial Magistrate-Ist Class, Ara. (Hemant Kumar Srivastava, J) A.K.V./- U T
