JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report but no specific over act has been attributed against them. In course of investigation, one independent witness at Para 53 of the case diary stated that co-accused Jaggu Yadav assaulted the deceased by means of brick. The post mortem report reveals that only one injury on the scalp of the deceased was found and the aforesaid injury became fatal.

Learned counsel for the petitioner points out that coaccused Jaggu Yadav against whom there is allegation of pelting brick blow has already been granted privilege of bail by the

Patna High Court Cr.Misc. No.13426 of 2015 (3) dt.26-06-2015 2/2 learned court below itself, and similarly one co-accused Hari Charan having similar allegation has already been granted bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Maharajganj ( G.B.Nagar) P.S.Case No. 287 of 2014.
