The petitioners apprehend their arrest in connection with Bachhawara P.S. Case No.190 of 2021 instituted under Sections 341,323,353,427,504,506,34 of the IPC. The allegation in the FIR is that, the process of filling of the college form was going on when these petitioners tried to interrupt the same and also some documents were destroyed. Accordingly, the FIR was lodged.

Learned counsel for the petitioners submit that this is a counter blast to the earlier Bachhawara P.S. Case No.189 of 2021 lodged by the petitioners against the staffs of the college,

Patna High Court CR. MISC. No.50292 of 2022(2) dt.10-01-2023 2/2 upon knowledge that the college is closed and everything is being done at the residence of the Principal. Learned APP on the other hand opposes the prayer for anticipatory bail.

Taking into account the fact that it is a matter of case and counter case, the petitioners do not have criminal antecedent and ultimately they have to face the Trial and are ready to cooperate in the investigation, this Court is inclined to grant them relief.

Let the petitioners be released on bail, in the event of their arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Bachhawara P.S. Case No.190 of 2021 to the satisfaction of learned Additional Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
