JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 04.01.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends her arrest in connection with Chautham P.S. Case no. 137 of 2020, registered under Section 304(B) of the Indian Penal Code.

The accusation is that Kapil Deo Yadav, son of Ramotar Yadav received information in the morning of 20.05.2020 that his daughter Sanjo Devi, aged about 30 years, has been killed by Kapildeo Yadav @ Poplesh Yadav, Subhash Yadav, Mahendra Yadav all sons of Late Subhaklal Yadav,

Patna High Court CR. MISC. No. 1573 of 2021(2) dt.02-09-2021 2/2 Anila Devi, wife of Mahendra Yadav, Sudha Devi, wife of Subhash Yadav and mother of Kapildeo Yadav by hanging due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that petitioner is the Gotani of deceased Sanjo Devi and she used to reside separate from Kapildeo Yadav @ Poplesh Yadav, husband of deceased, but, with ulterior motive, the petitioner has falsely been implicated in this case. Further submission is that Kapildeo Yadav @ Poplesh Yadav, husband of deceased, is in custody since 19.10.2020. The petitioner, who is lady, has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ms. Alka Roy, Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S. Case No. 137 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
