JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 08-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In a pre-planned manner, there was expectation at the hands of the petitioner and others to assemble at a particular point with arms and ammunitions to commit dacoity. It was informed to the police officials and on account thereof, a raid was conducted and during the course thereof, different accused persons were apprehended at different places along with the fire arms and ammunitions. So far petitioner is concerned, he was arrested at his house and on search a country made loaded pistol along with live cartridges were recovered and seized.
At an earlier occasion, prayer for bail of the petitioner was withdrawn under Criminal Misc. No. 27358 of
Patna High Court Cr.Misc. No.10940 of 2015 (2) dt.08-05-2015 2014. Petitioner happens to be under custody since 21.02.2014 and on account thereof petitioner Rahul Mishra is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 84 of 2014. An undertaking will be tendered by the petitioner with definite assertion that hence forth he will not indulge in any criminal offence, failing which the privilege given to the petitioner will automatically cease.
