The petitioners, three in number, seek bail in a case registered under Sections 302, 307 and other sections of the Indian Penal Code.
Ashok Tanti named the petitioners and alleged that Dilip Tanti cut the necks of Shambhu Tanti and Saramen Devi, the mother of the informant. Both died on the spot. It is further alleged that Dilip Tanti assaulted Wakil Tanti and Neelam Devi with sickle on their hands.
Learned counsel for the petitioners submits that the petitioners are alleged to have conspired with Dilip Tanti but there is no allegation of assault against the petitioners. It appears that only Dilip Tanti is alleged to have
Patna High Court Cr.Misc. No.7404 of 2015 (2) dt.23-02-2015 2/2 assaulted Shambhu Tanti, his mother, brother and wife of Wakil Tanti. Shambhu Tanti and Saramen Devi died on the spot. Considering the fact that the petitioners are not the assailants, the above named petitioners are directed to be enlarged on bail in Bakhtiyarpur P.S. Case No. 25 of 2014 on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa.
