The petitioner seeks bail in Tisiauta P.S. Case No. 23/2019, instituted for offences under Section(s) 341, 323, 307, 427, 436, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner in the written report that he along with other named accused persons set the house of Bhuneshwar Paswan on fire. It is alleged in the written report that on the date of occurrence petitioner along with other accused persons set the house of Bhuneshwar Paswan on fire. It is further alleged that on the order of petitioner and co-accused Sonu Paswan, Shankar Paswan and Mahesh Paswan gave Farsa blow to the informant
Patna High Court CR. MISC. No.46042 of 2019(2) dt.31-07-2019 2/2 causing injury on his head.
In this manner, there is no allegation of specific overt act against this petitioner.
Petitioner is in custody since 19.05.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hajipur at Vaishali, in connection with Tisiauta P.S. Case No. 23/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
