Petitioner seeks regular bail in connection with Rajpur PS Case No. 64 of 2021 registered under Section 25 (1b) a / 26 / 35 of the Arms Act and Section 30 (d) of the Bihar Prohibition & Excise ( Amendment ) Act, 2018. The allegation is that one live cartridge and one country made revolver have been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that petitioner is having no criminal antecedent and he has falsely been implicated in this case by Police with oblique motive. He next submits that fire arm and cartridge have not been recovered from conscious possession of the petitioner and the same have been recovered from chapel (Puja Ghar) of the house. He

Patna High Court CR. MISC. No.57820 of 2021(2) dt.27-04-2022 2/2 next submits that the house is a joint family property in which other family members also reside. No illicit liquor has been recovered from the possession of the petitioner. Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner is in custody since 23/03/2021 having no criminal antecedent, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000 /- ( twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge Excise, Buxar in connection with Rajpur PS Case No. 64 of 2021.
