2. The petitioner seeks bail in Kotwali P.S. Case No. 501 of 2023 registered for the offence punishable under Sections-379, 414 of the Indian Penal Code.

3. It is alleged that the informant's motorcycle, parked near his shop, was tried to be taken away but on an alarm raised by the informant, the miscreant was apprehended with motorcycle and disclosed his name as the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that as a matter of fact, the petitioner has gone to purchase some articles to the shop of

No.52582 of 2024(2) dt.02-08-2024 2/2 the petitioner and during purchase, exchange of some hot talk took place between the petitioner and the informant and that is why, the petitioner has been made accused in the present case. The petitioner is in custody since 16-08-2023.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, specially the period of custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 501 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
