====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case registered under Sections-147, 148, 149, 341, 323, 386, 307, 427, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act. Prosecution case in short is that the co-accused demanded extortion money which was not given by the informant as a result of which, firing took place in the occurrence.

It has been submitted that here is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.47762 of 2022(2) dt.20-12-2022 2/2 petitioner is in custody since 02-06-2022. Charge sheet has already been submitted in this case. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. Altogether 22 named and 15-20 unknown persons are made accused in the present case.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Jhanjharpur, Madhubani in connection with Bheja P.S.
