JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 21-02-2018 The present writ petition has been filed for quashing the order dated 18.12.2015 passed in R.P. Case No. 29/2006 by which the Recovery Officer, Debts Recovery Tribunal, Patna had confirmed the sale of immovable property of the petitioner and issued sale certificate.

2. Learned counsel for the petitioner fairly accepts that statutory appeal is available against the impugned order which has not yet been availed.

3. In the above view of the matter, the writ petition stands disposed of with liberty to the petitioner to seek redressal of his grievances before the statutory appellate forum in accordance with law.

4. It is made clear that in case such an appeal is filed, the concerned authority would have regard to the present proceeding being pursued by the petitioner while considering any issue relating to condonation of delay, if applicable.
