The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 202 litres of illicit liquor was recovered from a tempo and the two petitioners were taken into custody.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from possession of the petitioners and they have been falsely implicated in this case. The petitioners are in custody since 30.06.2021 and have no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioners have no criminal antecedent, the Court directs both the petitioners to be enlarged on bail in connection with Jamhore P.S. Case no. 80 of 2021 on each of them furnishing bail bond of Rs 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IIcum- Special Judge, Excise, Aurangabad.
