JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Teghra P.S. Case No. 124 of 2017, registered under Sections 147, 148, 149, 341, 342, 323, 353, 333, 307, 504, 109 and 435 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on receiving information about blockage of road at Paigambarpur near Tegra the informant and other Police officials reached there then saw that 100-150 pepole having lathi, danda and bricks in their hand blocked the road. The motorcycle and other wooden materials were put on fire there and on information the fire brigade vehicle also reached there, anyhow informant and other police officials tried to pacify the situation,

Patna High Court Cr.Misc. No.47559 of 2017 (2) dt.06-10-2017 but mob stated raising slogans against the Police administration and causing assault through pelting stones and firing was also being made by the mob.

The local Chokidar and Dafadar disclosed the name of 38 persons including the petitioners as member of the mob.

Learned counsel for the petitioners submits that petitioners are own brothers and they are resident of village Daniyalapur Bhathhapar, 4 K.M. away to the place of occurrence and their names have been disclosed by Choukidar due to ulterior motive. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S. Case No. 124 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
