ANJANA MISHRA ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 06.01.2016 in connection with Dholbajja P.S. Case No.51/2013 for the offences punishable under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner was taken into custody in connection with Dholbajja P.S. Case No.01/2016 under Sections 25 (1-B) a, 26, 35 of the Arms Act and has been subsequently remanded in the present case. The learned counsel further submits that though the petitioner is not named in F.I.R but subsequently his name has been surfaced on the basis of suspicion. Patna High Court Cr.Misc. No.3692 of 2016 (2) dt.08-02-2016 identified by any of the eyewitness in the occurrence even though he happens to be a co-villager. He further submits that the petitioner has been acquitted in one case and in other case he has been granted the privilege of regular bail.

Considering the nature of allegation made against the petitioner and also that one of the similarly situated co-accused namely Fullo Mandal @ Fulo Mandal has been extended the privilege of regular bail in Crl. Misc. No.4988/2014 vide order dated 20.03.2014, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Naugachia in connection with Dholbajja P.S. Case No.51/2013.
