JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Gaurichak P. S. Case No. 200 of 2017 registered under Sections 341, 323, 448 and 354 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner is a young boy having no criminal antecedent and the only allegation made in the FIR against him is that he asked the informant of the case to flee away with him. He submitted that the petitioner being a neighbour of the informant has been implicated in this case under some confusion.

No.53297 of 2017 (3) dt.19-12-2017 2/2 On the other hand, learned Additional Public Prosecutor for the State submitted that there is allegation in the FIR that the petitioner entered into the house of the informant and tried to persuade her to run away with him. I have heard learned counsel for the parties. Considering the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in Gaurichak P. S. Case No. 200 of 2017 corresponding to G. R. No. 2201 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
