2. Learned counsel for the petitioners submits that petitioner no. 3 has been arrested, as such, he seeks to withdraw this bail application with respect to petitioner no. 3 namely, Rampujan Ram @ Pduram.
3. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Bihta P.S. Case No. 359 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 427, 332, 333, 353 of the Indian Penal Code.
4. The case of the prosecution is that 47 known and
Patna High Court CR. MISC. No. 48724 of 2025(2) dt.05-08-2025 2/3 20-25 unknown persons damaged police jeep and caused hindrance in discharge of official duty of police team. They also assaulted some police personnels due to which some of the police personnel sustained injury.
5. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. He also submits that the nature of allegation is general and omnibus. There is no specific allegation against any of the petitioners. He further submits that similarly situated other coaccused persons have already been granted bail by Co-ordinate Benches of this Court vide order dated 19.07.2022 passed in Cr. Misc. No. 69693 of 2021 and order dated 16.05.2023 in Cr. Misc. No. 9387 of 2023. The case of these petitioners stands on similar footing.
6. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioners and submits that petitioner no. 5 has criminal antecedent of one case whereas petitioner nos. 1,2 & 4 are having no criminal antecedent.
7. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner nos. 1, 2, 4 & 5 on
Patna High Court CR. MISC. No. 48724 of 2025(2) dt.05-08-2025 3/3 bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Bihta P.S. Case No. 359 of 2020, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, Danapur, Patna, subject to the conditions as laid down under section 438(2) of the Cr.P.C/ section 482(2) of the BNSS.
