====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Makhdumpur P. S. Case No. 45/2020 in a case registered for the offences punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, on the alleged date and time of occurrence, when informant was going to the bank to deposit cash of Rs. 13,38,870/-, three unknown miscreants fired bullet upon him and snatched the bag full of cash.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation on the basis of confessional statement of co-accused and no stolen money has

Patna High Court CR. MISC. No.48037 of 2025(2) dt.29-08-2025 2/2 been recovered from his possession. Till date, petitioner has not been put on Test Identification Parade, despite being in custody since 09.05.2025. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Jehanabad in connection with Makhdumpur P. S. Case No. 45/2020 (G.R. No. 163 of 2020).
