The petitioner apprehends his arrest in connection with Fenhara (Phenhara) P.S. Case No. 57/2020, registered for the offence punishable under Section 379 of the Indian Penal Code.

The allegation against the petitioner is said to have stolen the motorcycle, this is not a fit case for grant of anticipatory bail.

Considering the above facts, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail is hereby rejected.

Accordingly, this application is disposed of. In case the petitioner surrenders and prays for regular

Patna High Court CR. MISC. No.2047 of 2021(2) dt.15-11-2021 2/2 bail before the Court below within a period of four weeks from today, the Court below will consider the petition for regular bail of the petitioner without being prejudiced by the fact that anticipatory bail petition has been rejected by this court. The Court below also consider the fact that the name of the petitioner has come up on the basis of confessional statement and there is no recovery from him.
