JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Rajnagar P.S. Case No. 179 of 2015 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. First Information Report is against 15-20 un-known. During investigation the spy of the police stated the name of the petitioner that he was seen playing gambling before some day of the occurrence and thereafter the petitioner was arrested and he confessed his guilt.

Submission is of false implication and that the petitioner is not named in the First Information Report, he is in

Patna High Court Cr.Misc. No.4016 of 2016 (3) dt.18-03-2016 2/2 custody since 24.08.2015. He has not been put on TIP and as the petitioner has got criminal antecedent, he has been implicated in this case, nothing has been recovered from his possession and, as such, he deserves sympathetic consideration to which the learned A.P.P. fairly submits that besides the confessional statement of the petitioner and his criminal antecedent, there is no other material against him.

In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri. S.B. Kumar, learned J.M. 1st Class, Madhubani in connection with Rajnagar P.S. Case No. 179 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
