JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The police raided the house of co-accused Rajendra Paswan and caught the petitioner and co-accused Rajendra Paswan from whom possession one country made pistol along with two cartridges were recovered and from the rented room of the coaccused Rajendra Paswan, several theft articles were recovered. The contention on behalf of the petitioner is that neither the aforesaid recovery was made from conscious possession of the petitioner nor from his house and as a matter of fact, prior to institution of the present case, petitioner had not been made accused in any case but when co-acused Rajendra Paswan confessed his guilt in the present case , the police implicated the

Patna High Court Cr.Misc. No.4211 of 2016 (2) dt.09-02-2016 2/2 petitioner in several cases in which co-accused Rajendra Paswan had confessed his involvement.

From perusal of Para-3 of the petition, I find that altogether 14 cases are said to have been registered against the petitioner but taking note of the aforesaid submissions as well as facts and circumstances of the case, particularly, keeping in mind that prior to institution of the present case, petitioner had not been made accused in any other case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Gaya in connection with Buniyadganj P.S.Case No. 188 of 2015.
