The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 366, 366(A)/34 of the Indian Penal Code.

It is a case of abduction of daughter of the informant by the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that petitioner is languishing in judicial

Patna High Court CR. MISC. No.47755 of 2022(3) dt.19-01-2023 2/3 custody since 15.05.2022. The victim has been recovered and she has recorded her statement under Section 164 of Cr.P.C. that the petitioner has offered her Pan and thereafter, she became unconscious and petitioner has taken her away. She has not whispered about the commission of wrong with her by the petitioner. In the medical examination of the victim, there is no sign of commission of any wrong to her. It is further submitted that petitioner is about 63 years of age. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Nirmali(Kunauli) P.S. Case No. 07 of 1995 on

Patna High Court CR. MISC. No.47755 of 2022(3) dt.19-01-2023 3/3 furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st -cum-Special Judge, Supaul.
