The petitioner apprehends his arrest in Bhagwanpur P.S. Case No.131 of 2017 registered under Sections 467, 468, 471, 420, 120B/34 of the Indian Penal Code.
The case was registered against different persons appointed on the post of teachers on the allegation that they on forged BETET certificate with the help of officers of employment Units got service.
The learned counsel for the petitioner submits that after verification, it was found that the father name of the petitioner does not tally. The name of the father of the petitioner is Ramashish Singh but in the BETET certificate, the name of his
Patna High Court Cr.Misc. No.5142 of 2018 (2) dt.02-02-2018 2/2 father has been written as 'Ram Preet Singh'. The learned counsel for the petitioner further submits that due to inadvertence in place of Ramshish Singh, Ram Preet Singh has been written. Later on petitioner filed affidavit stating that Ram Preet Singh and Ramshish Singh is the same person.
On the other hand, the learned counsel for the Vigilance vehemently opposed the prayer for anticipatory bail. Considering the facts aforesaid and the fact that the none of the certificate of the petitioner was found forged or fake and only name of the father of the petitioner has been wrongly typed as Rampreet Singh in place of Ramshish Singh, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bhagwanpur P.S. Case No.131 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
