The petitioner seeks bail in Mahnar P.S. Case No. 81/2019, instituted for offences under Section(s) 147, 148, 149, 353, 307, 420, 467 and 468 of the Indian Penal Code read with Sections 25(1-A), 25(1-B)a, 26, 27 and 35 of Arms Act. Learned counsel for the petitioner has submitted that there is no recovery of any incriminating article from possession of this petitioner. There is no injury on the side of police, as per F.I.R.
It is alleged in the written report that police got information that leader of inter-state gang Manish Singh has arrived. On the basis of aforesaid information, police reached at
Patna High Court CR. MISC. No.46032 of 2019(2) dt.31-07-2019 2/2 the place of occurrence where accused persons started firing at police force. Thereafter police force made counter firing in which three persons sustained bullet injury. It is alleged that three persons including this petitioner surrendered before the police force. On search, no incriminating article was recovered from possession of this petitioner.
Petitioner is in custody since 18.03.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 81/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
