JUSTICE ARUN KUMAR ORAL ORDER 10-11-2017 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Bajpatti P.S. Case No.147 of 2017, registered under Sections 341, 323, 307, and 379/34 of the Indian Penal Code. Allegation is that the accused persons objected installation of a hand-pump by the informant claiming the land of their own leading to quarrel and allegation is that this petitioner, Arun Kumar Mandal gave a spade blow on the left hand of the informant.
Learned counsel for the petitioner submits that both sides are agnates, there is land dispute, the so called injury on the hand of the informant is found simple in nature and the petitioner
Patna High Court Cr.Misc. No.53075 of 2017 (2) dt.10-11-2017 2 /2 has got no criminal antecedent.
Having considered the said facts and circumstances, let petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sitamarhi in connection with Bajpatti P.S. Case No.147 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
