The petitioners apprehend their arrest in connection with Bisfi P.S. Case No.36 of 2017 registered under Sections 341, 323, 379, 504, 506, 34 of I.P.C. and Sections 8 and 12 of POSCO Act. Accusation of the informant is that her daughter was being teased by petitioner no.1 but due to fear her daughter did not make any complain. On 16.02.2017 while daughter of the informant was returning to her house petitioner no.1 took her and
Patna High Court Cr.Misc. No.48050 of 2017 (2) dt.11-10-2017 2/3 tried to board her on motor cycle saying that he will perform the marriage with her and tried to outrage her modesty. When she opposed the petitioner no.1 slapped on her chik upon which she started crying and when some people of nearby rushed there petitioner no.1 fled away. Thereafter the daughter of the informant came to her house and narrated the whole episode to her mother and father. Thereafter husband of the went to the parents of the petitioner no.1to make complain where other petitioners abused the informant saying that your daughter will have to marry with our son otherwise you will have to face the dire consequence. At that time the informant was also assaulted by the petitioners and his gold chain was also snatched.
Learned counsel for the petitioners submits that prior to the present occurrence hot talk were exchanged between the informant and the petitioners and to that effect petitioner no.3 Noorjahan Khatoon filed Bisfi P.S.Case No.30/17 against the informant, her husband and others on 13.02.2017 and present Bisfi P.S. Case No.33/17 is lodged on 15.2.2017 only to put pressure upon the petitioners with false allegation. The petitioners have clean antecedent.
Having considered the facts and the circumstances of the
Patna High Court Cr.Misc. No.48050 of 2017 (2) dt.11-10-2017 3/3 case, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be enlarged on bail on their furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.D.J..-I, Madhubani, in connection with Bisfi P.S. Case No.36 of 2017 corresponding to G.R.No.6/17,subject to the conditions laid down under Section 438(2) Cr.P.C.
