2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 303 (2) of the BNS 2023,

3. The case of the prosecution, in brief, is that the informant had gone to attend the Baraat of one Sheo Shankar Sah in his four-wheeler Bolero vehicle. He parked the said vehicle but when he returned after about 30 minutes, he found that his Boloero car was missing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the FIR was lodged against unknown miscreants, however, during the course of investigation, the name of this petitioner was

Patna High Court CR. MISC. No.46106 of 2025(3) dt.15-09-2025 2/2 disclosed by one Nandu Chaurasiya. It is further submitted that the said Nandu Chandu Chaurasiya and others having similar nature of allegation have been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 55057 of 2025 and Cr. Misc. No. 48008 of 2025. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 08.04.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jagdishpur P.S. Case No. 38 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Champaran at Bettiah.
