Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that though there is allegation against the petitioner of misusing of privilege of bail but the same is not intentional or willful on the part of the petitioner, as the petitioner had gone out of the State for earning his livelihood, he could not appear before the court below thereafter his bail bond has been cancelled on 12.01.2020. The petitioner has suo moto surrendered in the

Patna High Court CR. MISC. No.2347 of 2021(2) dt.12-03-2021 2/2 court below on 20.08.2020 and since then he has been judicial custody. The petitioner is ready to abide by any condition imposed on him for grant of bail.

Learned APP for the State opposed the bail petition. The petitioner is directed to deposit a sum of Rs. 1,000/- (Rupees One Thousand) in the District Legal Services Authority.

Considering the aforesaid facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with S.Tr. No. 240/2019 arising out of Bhabua P. S. Case No. 340/2019 (G.R. No.1305/2019). The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of Rs.1,000/- (Rupees one Thousand) in the District Legal Services Authority.
