JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-05-2023 The present writ petition has been filed seeking the following reliefs:- "1(A). To hold the appointment of private respondent no. 11 who was initially appointed as Shiksha Mitra later on Panchayat Shikshak in Gram Panchayat Raj, Sahuli, P.S- Hussainganj. District- Siwan by playing fraud who is presently posted in Upgraded Middle School,

Patna High Court CWJC No.12381 of 2022(2) dt.05-05-2023 2/2 Prasadipur, Block -Hasanpura, District- Siwan is by way of fraud, nullity, void, illegal and bad in law.

(B)Also for commanding the respondents to recover the salary paid to the private respondent who has entered into the service after playing fraud in order to compensate the loss of the public money.

(C) Also for commanding the respondent Director, Primary Education, Govt. of Bihar, Patna to produce the record of the private respondent no. 11, indicating appointment letter marks of the private respondent, categories of private respondent and merit list and roster of the private respondent no. 11 prepared by Gram Panchayat Raj, Sahuli at the time of appointment and further be pleased to quash the appointment letter of the private respondent no. 11."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
