JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Basnahi P.S. Case No. 20 of 2017 registered for the offence punishable under sections 406, 409, 420, 467, 468, 471/120B of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case as petitioner has no concern with the alleged occurrence. In this connection, a departmental enquiry was also held in which petitioner has been set free. Moreover, similarly situated co-accused person has been granted bail by this Court vide order datd 29.06.2017 passed in Cr. Misc. No. 20323 of 2017 (Annexure-8). During

Patna High Court Cr.Misc. No.54270 of 2017(2) dt.21-12-2017 2/2 investigation also, nothing has come to suggest complicity of this petitioner in the alleged offence. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, IV, Saharsa in connection with Basnahi P.S. Case No. 20 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
