The petitioner apprehends his arrest in connection with Hathori (Shivajee Nagar O.P.) P.S. Case No. 39 of 2019 registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is based on speculation and suspicion and there is nothing to show that the petitioner was in anyway involved in the occurrence. It is further submitted that the informant herself stated that she had information that her husband was badly injured in a road accident, but only because the villagers had loaded the deadbody of the deceased on the tractor of the present petitioner, the

Considering the entire facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Samastipur, in connection with Hathori (Shivajee Nagar O.P.) P.S. Case No. 39 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
