The petitioner seeks bail in Sabour P.S. Case No. 240 of 2019 corresponding to Sessions Trial No. 26 of 2020, registered for the offence punishable under Section 302 of the Indian Penal Code.
As per the prosecution case, on 05.08.2019 at 7.00 pm, informant's father-in-law had gone out of home, but he did not return. On the next day, she got information on mobile from her relative that her father-in-law has been murdered by someone by pricking knife in his neck. She reached at the place of occurrence and found his dead body.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner is
Patna High Court CR. MISC. No.1833 of 2021(2) dt.08-03-2021 2/3 not named in the FIR. Name of this petitioner has come in this case on the basis of confessional statement of co-accused Meena Devi. There is no eye witness of the occurrence. Co-accused Meena Devi has already been granted bail by a coordinate Bench of this court vide order dated 08.06.2020 passed in Cr. Misc. No. 6352 of 2020 (Annexure-2). Petitioner is in custody since 09.08.2019 having no criminal antecedent. Chargesheet has already been submitted.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge X, Bhagalpur in connection with Sabour P.S. Case No. 240 of 2019 corresponding to Sessions Trial No. 26 of 2020, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.
