This application for anticipatory bail arises out of Baikunthpur P.S. Case No. 49 of 2020 for the offence under Sections 272 & 273/34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. At the very outset, learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no.1 namely, Raju Rai, as he has already been granted regular bail by a coordinate Bench of this Court. Accordingly, this bail application is dismissed as withdrawn as against petitioner no.1 namely, Raju Rai. After some arguments, learned counsel for the
Patna High Court CR. MISC. No.2390 of 2021(2) dt.15-11-2021 2/2 petitioners seeks permission to withdraw this bail application on behalf of petitioner no.2 namely, Pankaj Rai. Permission, as prayed for, is granted. Accordingly, this bail application is dismissed as withdrawn as against petitioner no.2 namely, Pankaj Rai.
However, if the petitioner no.2 surrenders before the Court below within a period of four weeks from today and seeks regular bail, the Court below will consider and decide same on its own merit without being prejudiced by this order. The Court below will also consider the fact that petitioner no.1 namely, Raju Rai, has been granted regular bail by this Court. (Sandeep Kumar, J) pawan/- U T
