Petitioner is in jail custody since 16.7.2015 in a case registered under sections 302, 201/34 of the Indian Penal Code. Petitioner is not named in the first information report but it appears that in course of investigation, petitioner was arrested and confessed his guilt disclosing the manner in which deceased was killed.
Submission on behalf of the petitioner is that in course of investigation, petitioner was arrested on suspicion that he had illicit relation with wife of the deceased and thereafter, police got recorded so-called confessional statement which does not have any evidentiary value. It is further submitted that moreover, investigation has already been completed.
Considering the aforesaid facts and circumstances as well as
Patna High Court Cr.Misc. No.5017 of 2016 (2) dt.12-02-2016 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge, Rosera District Samastipur in Sessions trial no. 626/2015 arising out of Rosera P.S. Case no. 158/2015.
