The petitioners seek bail in a case registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code.

The widow of the deceased disclosed that her husband went to court for bail of Ajay Kumar Pandey on 12.11.2014 and he returned, at about 8:00 P.M. in the night. Vidyanand Singh @ Viddi Singh and Ashok Das the petitioners took the husband of the informant to village Dadhia. The informant got information from Magnu Ram that her husband was lying unconscious near a pond. It is submitted that brother and sister-in-law of the deceased in para -7 and 34 of the case diary disclosed that the

Patna High Court Cr.Misc. No.8619 of 2015 (5) dt.05-08-2015 2/2 deceased had gone to court but he did not return. His dead body was lying near the pond. Magnu Ram firstly informed the informant about the lying of the deceased near the pond. No external injury except one abrasion on head was found on the dead body of the deceased. According to the F.S.L. report the deceased had taken Methyl Alcohol and Ethyl Alcohol in excessive quantity. Methyl Alcohol is poisonous and on account of Methyl Alcohol the deceased died.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Dalsingsarai in Samastipur in Angarghat P.S. Case No. 105 of 2014.
