JUSTICE SANJAY PRIYA ORAL ORDER 08-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Dandari P.S. Case No. 43/2017 instituted for the offence under Sections 376 and 506 of the Indian Penal Code and sections 6 and 8 of the P.O.C.S.O. Act.
As per the written report there is specific allegation against this petitioner of entering into the house of the informant and committing rape with her. Learned Addl. Sessions Judge Ist, Begusarai mentioned in the impugned order that the victim girl in the statement recorded under Section 164 Cr.P.C. as mentioned in paragraph-28 supported the allegation. Other witnesses also supported the case and in the medical examination it is also mentioned that the victim girl is minor.
Patna High Court Cr.Misc. No.51680 of 2017 (2) dt.08-11-2017 2/2 Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly the same is rejected.
If the petitioner surrenders in the court below and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner on its own merit and dispose of the bail petition as early as possible.
